Julia Peng is a senior associate with Fujian Fidelity (Shanghai) Law Firm ("Fidelity"), the Chinese law firm with which Hogan Lovells has entered into an association in the Shanghai Free Trade Zone (the "Association"). The Association is a contractual joint venture that functions as a Chinese law firm and provides the full range of Chinese legal services, including litigation in the Chinese courts.  Prior to joining Fidelity, Julia was an intellectual property ("IP") associate with Hogan Lovells and its affiliated intellectual property service agency for over 8 years. 

Julia's practice focuses on IP enforcement, with particular experience in patent and trade secret civil litigation, patent administrative enforcement, as well as criminal IP actions.  Julia also assists clients with copyright enforcement, brand protection and portfolio management in China.  She has an electrical engineering technical background and also deep industrial knowledge from her experience in acting for clients from a variety of specialized industries, including chemicals, pollution treatment, metal processing, semi-conductors and software.

  • Acting for a leading European chemical company to defend trade secret misappropriation claims involving complicated technical know-how, as well as analysing and advising on large numbers of prior art patents in China;

  • Acting for a leading German chemical company against trade secret theft in China involving complicated technical know-how, including successfully obtaining an interim evidence preservation order;

  • Advising world-leading ecological environmental technology company on complicated patent infringement and trade secret misappropriation matters in China, as well as acting on invalidation against infringer’s patent and advising on inventorship disputes in China;

  • Acting for the world's leading manufacturer of plasma arc cutting torches in a number of patent civil litigation and administrative enforcement matters, patent invalidation defense as well as other IP enforcement actions in China for 7 years, including handling the same client’s all IP enforcement matters exclusively in China for over five years;

  • Assisting a leading US high-tech company in the area of water, food and environmental hygiene and safety solutions on cross-border technology transfer agreement negation concerning a series of its key products;

  • Advising a leading media packaging company on design patent infringement in China;

  • Advising the world’s largest toy company in design patent protection strategies in China, as well as on copyright, trademark and unfair competition claims against copycat products;

  • Advising an European luxury furniture company on design patent protection strategy and copyright enforcement in China;

  • Handling various European design patent searches and providing freedom-to-operate advice for a Chinese client;

  • Acting for a multinational electric company on several contentious matters involving the manufacture and sale of counterfeit products, including a private criminal prosecution in China, a public prosecution in Middle East, and a civil litigation against an investigation company for breach of duties;

  • Acting for a renowned computer chip company to secure a series of successful civil actions against infringing shop, website and domain names in China;

  • Acting for the owner of the world's largest online electronic business website through several successful civil actions and a large number of cease and desist letters against trademark infringement and unfair competition through domain names in China;

  • Representing the European licensee of a world-famous cartoon image and brand in enforcing its copyright and trademark rights against joint infringers in China.

  • Acting for a various clients in the industries such as game devices, luxury, fast fashion, food and drinks etc. on a large number of anti-counterfeiting cases, including civil litigation, customs enforcement, administrative actions, and domain name complaints;

  • Acting for a US pharmaceutical company on administrative and criminal actions against fake drugs;

  • Advising several clients on compliance matters of the Advertising Law in China;

  • Advising litigation or alternative dispute resolution strategies for several US and European medical and industrial companies in China concerning negligence, debt dispute and breach of sales representative contracts.
